What is a Power of Attorney (POA)?

A Power of Attorney is a vital legal document that grants a designated person (the agent) the authority to act on your behalf. To be official and legally enforceable, a POA requires notarization by a Notary Public and often requires witnesses.

Common Reasons to Notarize a POA or Estate Document:

  • Healthcare Directives: Assigning someone to make medical decisions if you are incapacitated.
  • Financial Management: Giving a trusted agent authority to handle bank accounts, investments, or business matters in your absence.
  • Real Estate Transactions: Authorizing someone to sign a Deed or other document when you cannot be physically present.
  • Minor Child Care: Granting temporary guardianship or care authority to another adult

Making Your POA and Estate Plan Documents Official

For your Power of Attorney or other Estate Planning document to be officially recognized, a Notary Public must:

  1. Witness the Signing: The notary must be physically present to witness all signers execute the document.
  2. Verify Identity: The notary confirms the identity of the signers using a valid, current government-issued ID.
  3. Confirm Willingness: The notary verifies the signer is aware of what they are signing, is not under duress, and can communicate directly at the time of signing.

Once the notary applies their Notary Seal and signature, the document is officially notarized. Note: It is the customer's responsibility to consult an attorney for guidance on document preparation and any necessary court or county filing.

Important Legal Disclaimer

Notaries are NOT Attorneys. We cannot provide legal advice, select documents for you, or advise on the legal sufficiency of your Estate Plan documents. Please consult a qualified attorney for all legal guidance.

Witness Requirements for POAs and Wills

Witnesses are often a mandatory requirement for Powers of Attorney and Wills. You must check your specific document for witness signature lines.

  • Witness Eligibility: Witnesses cannot be mentioned in or stand to gain from the document. Ideal witnesses are unrelated parties like a family friend, neighbor, or co-worker.
  • Identification: Witnesses MUST be physically present for the signing and have a valid, current government-issued photo ID (Driver's License, State ID, or Passport).
  • Hospitals/Care Facilities: Please be aware that nurses, medical, or administrative staff will not sign as witnesses for non-medical legal documents.
  • Witness Provision: We can provide professional, non-related witnesses for an additional fee. This must be arranged by phone before scheduling your appointment.

What if a Signer Lacks Valid ID? (Credible Witnesses)

If a signer does not have a current, valid ID, the State of California allows for verification using Two Credible Witnesses who meet the following strict criteria:

  • They must personally know the signer.
  • They must be physically present and take an oath to affirm the signer's identity.
  • They must present their own current, valid ID.
  • They cannot be named in or benefit from the document being signed.

Preparation is Key: To avoid cancellation fees, ensure your documents are complete, all parties (including witnesses) are present, and all IDs are current before the Mobile OC Notary arrives. We are committed to making your Power of Attorney and Estate Plan notarization accurate and stress-free.
