Preparation Checklist for a Valid Notarization

To ensure a smooth and legal signing, please help the signer be ready for their appointment:

1. The Signer's Readiness

  • Capacity is Key: The signer must be capable of understanding the document they are signing. They must be able to clearly communicate their wishes to the notary without any coercion.
  • Current, Valid ID: The signer must present a current (non-expired), government-issued photo ID (Driver's License, State ID, or Passport).

2. Document Requirements

  • No Blanks: The entire document must be completed prior to the notary's arrival. The notary cannot notarize a document that has empty fields to be filled in later.

3. Witnesses (If Required)

  • Check Your Document: Look for specific spaces for witness signatures near the main signing area. If required, witnesses must be physically present during the signing.
  • Witness Eligibility: Witnesses cannot be named in or stand to gain from the document, nor can they be related to anyone mentioned in the document. Family friends, neighbors, or co-workers are ideal.
  • ID Required: All witnesses must present a current, valid photo ID.
  • Please Note: Medical staff, nurses, and administrative employees are typically prohibited from signing as witnesses for non-medical legal documents.

Special Circumstances: Credible Witnesses

If a signer does not have a current, valid photo ID available, the State of California allows for the use of Two Credible Witnesses to identify the signer.

  • Credible Witness Requirements: These individuals must be willing to swear under oath that they personally know the signer to be who they claim to be, and they must present their own current, valid photo ID. They also cannot be named in or benefit from the document being signed.
